What
is an industrial design?
An industrial design is the ornamental or aesthetic aspect
of an article. The design may consist of three-dimensional features, such as
the shape or surface of an article, or of two dimensional features, such as
patterns, lines or color.
Industrial designs are applied to a wide variety of products
of industry and handicraft: from technical and medical instruments to watches,
jewelry and other luxury items; from house wares and electrical appliances to
vehicles and architectural structures; from textile designs to leisure goods.
An industrial design is primarily of an aesthetic or visual
nature, and does not relate to the technical features of an article.
Requirements for Registration of a Design
Ø
Design should be new or original
Ø
Designs are not new or original if
they do not significantly differ from known designs or combination of design
features.
Ø
It should not be so registered in
respect of any article if it is the same as a design which before
the date of the application for registration has been registered in
Ø
It should not be published anywhere
in the world in respect of the same or any other article or differs from such a
design only in immaterial details or in features which are variants commonly
used in The trade.
Ø
An application for the registration
of a design must be made on a prescribed form
Ø
It must be accompanied by the
prescribed number of representations of the design
Ø
Or the specimen of the article
bearing the design and by the prescribed fee and affidavit in accordance with
Rule 63B
Ø
If it is desired to register the
same design in more than one class, a separate application must be made in each
class
